TikTok is a video social media app owned by Chinese company ByteDance that is particularly popular among teens. Of the app’s 65 million US users, roughly 40% are under the age of 18, and in 2019 it was the second-most downloaded app in the Google and Apple app stores.
Despite the app’s goofy, light-hearted nature, it has come under serious scrutiny for privacy concerns more than once. TikTok paid a $5.7 million fine to the FTC in 2019 for collecting personal information from kids under 13, which violates the federal Children’s Online Privacy Protection Act. While TikTok revamped its app to offer a restricted mode for younger users, it still remains very easy for minors under 13 to use a fake birthdate and sign up for the unrestricted version of the app.
What’s more is that TikTok uses facial recognition software to overlay animated filters over users’ faces, and in doing so, the app records biometric identifiers (that is, your child’s unique facial and other physiological characteristics). TikTok does not disclose to its users that it is recording such data or for what purposes the data is being used. This practice potentially violates various states’ privacy laws, including the Illinois Biometric Information Privacy Act.
