Keller Rohrback is investigating reports that consumers have started to receive unsolicited text messages from retailers who use the Square Reader, a very common white square-shaped device used by coffee shops, food trucks, farmers markets, and many other small businesses. The device is typically attached to smartphones or tablets, and retailers use it to insert, swipe, or tap customers’ credit cards during the checkout process.

When you request a text message receipt during checkout, Square retains your credit card information and phone number. If you make future purchases with that same credit card at any retailer that uses Square’s loyalty program, Square automatically subscribes you to unauthorized text messages regarding loyalty points.

If you did not provide the retailer with your phone number for this purpose at the time of your credit card purchase, it’s possible you’ve been receiving text messages that may violate state and/or federal law, as you did not consent to receive unsolicited texts or advertising—which is what loyalty texts are. Every unsolicited text you receive from one of Square’s clients is a potential violation of federal law, and each instance carries a fine of up to $1500.
