Despite taking the highest percentage from the sales of third-party merchants of any online retailer, Amazon prohibits third-party sellers from selling their products at lower prices on their own websites or on other e-commerce platforms, eliminating any price competition. Because products sold on Amazon.com do not face price competition, consumers miss opportunities to pay lower prices on non-Amazon platforms, and thus overpay for these products.
As the Court recently put it in denying Amazon’s Motion to Dismiss and allowing plaintiffs’ claims to proceed:
Amazon’s pricing policy requires sellers to add Amazon’s fees to the cost of their products when they sell them on all external platforms. The cost of the product is thus based on the price of the product itself—as set by the seller—plus the cost of Amazon-set fees, which are built into the product cost on the Amazon.com platform. Such a pricing provision could—and as Plaintiffs allege, does in fact—raise the cost of products on external platforms that charge lower fees than Amazon.
