Keller Rohrback L.L.P. is investigating Starwood Hotels & Resorts (“Starwood”) for breaching its fiduciary duties in violation of the Employee Retirement Income Security Act (“ERISA”). Starwood Hotels is one of the largest hotel companies, owning several hotels and resorts, such as: Sheratons, Westins, W hotels, & Marriott hotels. The company employs over 180,000 people throughout the world.
The investigation focuses on whether Starwood breached its fiduciary duties by allowing service providers of its retirement savings plan to charge participants excessive fees and by receiving improper kickbacks from the service providers. These breaches allegedly cost participants and beneficiaries of Starwood’s retirement savings plan hundreds of thousands of dollars in retirement earnings.
