Partner Derek Loeser appointed Interim Class Counsel in Microsoft commission pilfering case

Keller Rohrback is pleased to announce the appointment of partner Derek W. Loeser as Interim Class Counsel in the In re Microsoft Browser Extension Litigation.

The case is before the Honorable Ricardo S. Martinez of the United States District Court for the Western District of Washington. Derek shares Interim Class Counsel duties with Jason T. Dennett of Tousley Brain Stephens PLLC, Gary M. Klinger of Milberg Coleman Bryson Phillips Grossman, PLLC, and Adam Polk of Girard Sharp LLP.  He is joined on the Keller Rohrback litigation team by Cari Campen Laufenberg, Adele Daniel, Chris Springer, Kylie Fisher, and Andrew Lindsay.

The complaint, filed on January 14, 2025, arose from plaintiff’s allegations that Microsoft Corporation designed its Microsoft Shopping browser extension to steal affiliate commissions owed to online content creators. The complaint alleges that when a shopper clicks on an online content creator’s affiliate link and purchases a product, the online content creator typically gets credit for that referral and earns an affiliate commission. The Microsoft Shopping extension, offered as a free coupon-and-discount search tool on Microsoft’s Edge browser, allegedly usurps this arrangement by surreptitiously removing the online content creator’s affiliate code and replacing it with its own, depriving creators of the rewards for their legitimate marketing efforts.
