Did 3M knowingly sell defective earplugs to the U.S. military?
Keller Rohrback L.L.P. is investigating claims that government contractor 3M Company was aware that its Dual-Ended Combat Arms Earplugs Version 2 (CAEv2) had a design flaw that prevented the earplugs from fitting snugly in the ear canal. This alleged defect exposed users to dangerous levels of noise during training and combat operations. Veterans say they’ve experienced permanent hearing loss, tinnitus, and other hearing-related issues because of this defective product, which was sold to the military from 2003 to 2015.
The 3M Dual-Ended Combat Arms Earplugs, which have been discontinued, were green on one end and yellow on the other. If worn with the green end in, the earplugs were supposed to act as traditional earplugs and block as much sound as possible. If worn with the yellow side in, they were supposed to reduce loud impulse sounds—such as small arms fire, explosions, and artillery fire—while still allowing the user to hear low-level sounds, like verbal commands.
