On November 6, 2025, the Hon. George H. Wu of the U.S. District Court for the Central District of California, issued a ruling in the matter of In re TikTok, Inc., Minor Privacy Litigation, denying TikTok’s motion to stay, and denying in-part defendants’ motion to dismiss, allowing the majority of plaintiffs’ claims to proceed.

“We are very pleased with the court’s thorough opinion. This is an important first step in holding TikTok accountable for violating the privacy rights of minors,” said plaintiffs’ co-lead counsel Derek Loeser of Keller Rohrback L.L.P. and Eric Kafka of Cohen Milstein.

The case revolves around allegations that TikTok, among other defendants, unlawfully collected and used the personal information of children under 13 without parental knowledge or consent, as defined under the Children’s Online Privacy Protection Act (COPPA).
