Keller Rohrback is investigating reports that social media giant Twitter (TWTR) misused users’ telephone numbers and email addresses to sell targeted ads, profiting off of consumers’ private information.
In May of 2022, Twitter agreed to pay $150 million in civil penalties to resolve allegations that it used the phone numbers and email addresses users provided for two-factor authentication to in fact target advertisements. At the same time, Twitter misrepresented the extent to which it protected the privacy and security of users’ private information.
According to the Federal Trade Commission, starting in 2013, Twitter began asking users to provide phone numbers and/or email addresses to improve account security through two-factor authentication. Around this same time, Twitter also began collecting user phone numbers and/or email addresses for account recovery (that is, to reset or recover a password) and re-authentication (that is, to re-enable access after suspicious activity is detected).
Twitter did not disclose, however, that it was using these telephone numbers and email addresses to generate advertising revenue. Twitter offered services that allowed advertisers to target ads based on users’ private information. According to the Federal Trade Commission, moreover, Twitter falsely led consumers to believe that it would protect their personal information. This was in violation of a 2011 order which prohibited Twitter from misrepresenting its privacy and security practices.
Between 2014 and 2019, more than 140 million Twitter users provided their personal information to Twitter for the explicit purpose of securing their accounts.
