Case Update
On September 26, the parties filed a settlement agreement in a class action covering over two million Hyundai and Kia vehicles. Keller Rohrback represents plaintiffs who allege that certain Hyundai and Kia vehicles with Gamma and Nu gasoline direct-injection engines or Theta II multipoint injection engines are susceptible to premature and catastrophic engine failures and fires. Keller Rohrback partner Gretchen Freeman Cappio serves as Settlement Counsel for the proposed class.
The settlement would extend engine warranties to up to 15 years and 150,000 miles. It also provides reimbursements for previous repairs, payments to class members as compensation for out of pocket expenses related to towing, rental cars, and incidentals resulting from engine failures, and payments and rebates for class members who were forced to sell or trade in their vehicles. The settlement is subject to court approval. A hearing on preliminary approval is currently scheduled for November 18, 2022 before Judge Josephine Staton of the US District Court for the Central District of California. If and when preliminary approval is granted, class members will receive notice and opportunity to submit a claim. A final fairness hearing would then likely take place in autumn 2023.
