Case Status
On February 8, 2023, Judge Josephine Staton of the United States District Court for the Central District of California issued an order granting preliminary approval of a proposed settlement in the In Re Hyundai and Kia Engine Litigation II matter that will provide benefits to more than 2.1 million Hyundai and Kia owners. In that case, plaintiffs allege that a serious defect can cause engine failures and fires.
The settlement, once approved, will provide several categories of relief, including a 15 year/150,000 mile extended warranty covering inspection and repair costs related to the defect, reimbursement for qualifying out-of-pocket repair costs, goodwill payments of up to $150, reimbursements for transportation, towing, and travel expenses for class members stranded away from home by certain qualifying engine failures or fires, and a rebate program toward the purchase of a replacement Hyundai or Kia vehicle for qualifying class members.
Judge Staton’s order also appoints Gretchen Freeman Cappio of Keller Rohrback L.L.P. as Settlement Counsel for the class, alongside co-lead counsel from two other law firms.
A complete list of the Hyundai and Kia Class Vehicles can be found by reviewing the Order Granting Preliminary Approval of the Class Settlement. A notice program informing Class Members of the settlement and a website where Class Members can learn more about it will be launched in the coming weeks, and the Final Fairness Hearing is scheduled for September 8, 2023.
