Case Overview
On December 30, 2021, the Marshall Fire, the most destructive wildfire the State of Colorado has ever seen, began its deadly rampage through Boulder County. More than 1,000 homes and commercial buildings were damaged or destroyed, and approximately 6,000 acres of land were burned, in this tragic but preventable disaster.
According to the Boulder County Sherriff’s office, discharges from power company Xcel Energy Inc.’s powerlines were the most likely cause of the Marshall Mesa Trailhead fire, which merged with another blaze to form the larger, faster-moving Marshall Fire.
Keller Rohrback believes that Xcel Energy failed to take appropriate action to prevent this devastating fire and are holding Xcel Energy accountable for the preventable losses the fire caused.
Case Status
On August 25, 2023, Keller Rohrback filed its first complaint (Hughes, et al. vs. Xcel Energy, Inc., et al.) against Xcel Energy and subsequently filed six additional complaints. In total, those seven complaints include over 550 plaintiffs.
The cases are consolidated with the lead case, Kupfner, et al. v. Xcel Energy, Inc., et al., Case No. 2022CV30195, in front of Judge Christopher C. Zenisek in the District Court of Boulder County.
