Settlement Status
On July 22, 2022, Plaintiffs filed a motion for preliminary approval of a proposed class action settlement with T-Mobile regarding a data breach that T-Mobile announced on August 16, 2021. On July 26, 2022, the Court preliminarily approved the settlement to resolve all claims asserted in In re: T-Mobile Customer Data Security Breach Litigation. Kroll Settlement Administration was appointed to provide notice to members of the settlement class and to oversee the claims process and the distribution of settlement funds and services to class members. The Court-approved Notice Plan provided for notice through first-class U.S. mail, electronic mail, and/or SMS Text, as well as additional notice by publication and the creation of a settlement website, accessible at www.t-mobilesettlement.com. Notice to class members was fully completed on October 24, 2022, in accordance with the Preliminary Approval Order.
On January 10, 2023, Plaintiffs filed a motion for final approval of the class action settlement. On January 20, 2023, the Court held the Final Approval Hearing regarding that motion. The deadline to submit settlement claims passed on January 23, 2023. On June 29, 2023, the Court granted final approval of the settlement and awarded the requested attorneys’ fees, costs, and service awards. On July 31, 2023 and August 4, 2023, objectors to the settlement filed appeals, which will significantly delay the payment of claims. On October 25, 2023, the Eighth Circuit Court of Appeals ordered the consolidation of the appeals into a single case. Pending resolution of these appeals and any other delays, the settlement administrator will begin the distribution of benefits.

Case Overview
On August 15, 2021, online reports surfaced about efforts to sell personal information belonging to T-Mobile customers. Upon investigation, T-Mobile learned that a subset of the personally identifiable information (PII) data in their possession had been accessed by unauthorized individuals and the stolen data contained full names, dates of birth, Social Security numbers, and drivers’ license information of current, former, and prospective customers. T-Mobile has admitted this cyber-attack accessed the personal information of more than 76 million customers.
