Plaintiffs’ Counsel, including KR Partner Gretchen Freeman Cappio, are pleased to announce that a Consolidated Class Action Complaint was filed on August 9th, 2024 on behalf of the End-Payor Plaintiffs (EPP) track in the In re Passenger Vehicle Replacement Tires Antitrust Litigation. The litigation, consolidated before Chief Judge Sara Lioi of the Northern District of Ohio, is brought on behalf of consumers who allege overpayment for replacement tires for their vehicles. The Defendants are Continental Tires, Michelin, Nokian Tyres, Goodyear, Pirelli, Bridgestone, Sumitomo, Hankook, Giti, Kumho, Toyo, Yokohama, and their various parent companies. Plaintiffs allege Defendants coordinated a horizontal price-fixing agreement to set artificially high prices for new replacement tires, in violation of the Sherman Act as well as state antitrust and consumer protection laws.
