Settlement Status
On November 2, 2020, the Court granted preliminary approval to the proposed class action settlement.
On January 8, 2021, the Court-Appointed Administrator began sending a postcard-styled notice by U.S. Mail to the approximately 2.2 million individuals whose information was allegedly compromised in an October 2015 data breach of 21st Century Oncology. Please closely monitor your mail delivery and allow the U.S. Postal Service adequate time to effect delivery.
On June 25, 2021, the Court granted final approval to the class action settlement and entered the Order for Final Judgment. On June 28, 2021, the Court entered the Final Judgment. There is a thirty (30) day period following the Final Judgment during which any appeals may be filed. If no appeals are filed within that period, the “Effective Date” of the Settlement will occur, and the process of distributing Settlement Benefits will begin.

Case Overview
In 2016, Keller Rohrback L.L.P. filed three proposed Class Action Complaints against Florida-based healthcare provider 21st Century Oncology concerning the October 2015 data breach. All cases concerning the breach were consolidated in October 2016 for coordinated pretrial proceedings. On November 18, 2016, Keller Rohrback and Robinson Calcagnie were appointed Interim Co-Lead Counsel.
Plaintiffs allege 21st Century failed to secure the sensitive and confidential data entrusted to them, including full names, Social Security numbers, physicians' names, medical diagnoses, treatment information as well as insurance information for more than 2 million individuals. Plaintiffs also allege that 21st Century’s failure to secure, protect, and encrypt personal and medical information of those millions of individuals has made them vulnerable to the misuse of their data and has resulted in a lifelong battle to control any damage, such as fraudulent tax returns, stolen identities and/or medical fraud resulting from the breach.
