Case Overview
The Petitioners Anne Broome and William Gurtner filed this class action lawsuit on October 10, 2014. Petitioners are seeking increased benefits under the University of California Retirement Plan (“UCRP”) for themselves and a class that has been certified by the Court. Petitioners contend that class members are entitled to these increased benefits based on a 1999 resolution of the UC Regents adopting a “Restoration Plan” that included restoration of benefits that had been limited by application of a particular section of the Internal Revenue Code.
The Regents have denied all of Petitioners’ claims. The Court has not yet resolved the merits of those claims.

Case Status
The Court dismissed the class action claims before trial. A non-jury trial on the remaining claims began on October 7, 2019. The Court ruled in favor of defendants on plaintiffs’ individual claims. We appealed the court’s decision on both the class action and individual claims. The appeal has been fully briefed and oral argument is scheduled for May 31, 2022.
