Case Overview
Keller Rohrback and co-counsel filed cases against CIGNA Corp. for a billing practice known as a “clawback.” CIGNA is overcharging participants for drugs, by having them pay a co-pay that is higher than the actual cost of the drug, and then “clawing back” the difference for profit.
Most participants have no idea this happening to them because pharmacists are under a gag order that restricts pharmacists from telling participants they are being overcharged. These clawback monies are a contributing factor to the high prices of health care in our country and also contribute to the yearly compensations the CEOs of these companies receive.
CIGNA is taking advantage of people when they need help the most.
Case Status
The cases have been consolidated and Derek Loeser of KR was appointed to the Plaintiffs’ Executive Committee. The Amended Consolidated Complaint has been filed. Parties have briefed Defendants’ Motions to Dismiss and the Court ruled on the motions on March 12, 2018, allowing the case to move forward on the majority of Plaintiffs’ claims. Defendants have answered the Amended Consolidated Complaint and the case is in the discovery phase.
