Case Overview

On July 13, 2020, Keller Rohrback filed a class action complaint against Carnival Corporation, Carnival plc, and Princess Cruise Lines Ltd., in United States District Court for the Central District of California.

Plaintiff alleges that Princess Cruise Lines and its parent companies, Carnival Corporation & Carnival plc, failed to protect passengers aboard the Coral Princess cruise ship from the spread of COVID-19. At the time the Coral Princess departed on its March 5, 2020 voyage, the risk of cruising amid the rapid worldwide spread of the novel coronavirus was well known. The risk that passengers may contract COVID-19 on board was particularly well known to Princess and Carnival, which had already experienced outbursts of the deadly disease aboard at least two prior ships, the Grand Princess and the Diamond Princess. Notwithstanding this knowledge, Princess and Carnival not only set sail, but failed to take adequate measures to protect passengers on board the Coral Princess. The result was a nightmare voyage that was turned away from port after port, a lengthy quarantine, and many sickened passengers. The failure by Princes and Carnival—the world’s largest and most sophisticated cruise company—to take necessary precautions showed a gross disregard for its passengers’ welfare.

Plaintiff brings these claims on behalf of herself and similarly situated members of a proposed class defined at this time as: All persons in the United States who were passengers aboard the Coral Princess for the voyage departing from Valparaíso, Chile on March 5, 2020.

No specific class has been certified by the Court. If a class becomes certified, eligible class members will be notified when the Court authorizes a form of notice.
