Case Overview

This claim, filed under Sections 4 and 16 of the Clayton Act, 15 U.S.C. §§ 16 – 26 and Section 1 of the Sherman Act, § 1, concerning allegations of a conspiracy to fix, raise, stabilize and maintain the prices of Lithium Ion Battery Cells from at least as early as January 1, 2000 through at least May 31, 2011.  The conspiracy also artificially raised the prices of Lithium Ion Batteries and Lithium Ion Battery Products.  As a result of this activity, the Direct Purchaser Plaintiffs paid artificially higher prices for Lithium Ion Batteries and Lithium Ion Battery Products than absent the conspiracy, sums they sought to recover through this lawsuit.  In addition, Plaintiffs are seeking to recover treble damages and the costs of this lawsuit, including reasonable attorneys’ fees and to enjoin further violations.

Case Status

On October 2, 2014 the Court denied multiple motions to dismiss the complaint of the direct purchasers.

On September 7, 2016, the Court entered the Order Granting Final Approval of Class Action Settlement with the defendant Sony Electronics, Inc., approving a settlement that recovers $19 million for the class.

The litigation is continuing against the remaining defendants: LG Chem Ltd.; Samsung SDI Co., Ltd.; Panasonic Corporation; Sanyo Electric Co., Ltd.; Hitachi Maxell, Ltd.; GS Yuasa Corporation;  NEC Corporation; and Toshiba Corporation.

Proposed Class

All persons or entities that purchased a Lithium Ion Battery or Lithium Ion Battery Product from any Defendant, or any division, subsidiary or affiliate thereof, or any co-conspirator in the United States during the Class Period, from January 1, 2000 through May 31, 2011.

Excluded from the Class as Defendants, their parent companies, subsidiaries and affiliates, any Co-Conspirators, federal governmental entities and instrumentalities of the federal government, states and their subdivisions, agencies and instrumentalities, and any judge or jurors assigned to this case.
