In addition to the advance notice, if 20% or more employees who participate in the employer-sponsored retirement plan (e.g., 401(k) or a defined benefit pension plan) are laid off, federal employee benefits law (known as “ERISA”) requires that all plan participants become fully vested in the plan, regardless of whether they would otherwise be eligible. This is referred to as a “partial termination” of the plan.
